For models with a non-commercial license, users are restricted to using such models and their outputs for non-commercial purposes only. The Company provides non-commercial models strictly for demonstration purposes and will not charge more than the cost of hardware required for their use.
9. Generative AI Usage and Responsibility Disclaimer
This Service incorporates advanced generative AI technologies to create content in response to user inputs. We endeavor to ensure that the content produced is of a high quality; however, the accuracy, reliability, or suitability of AI-generated content cannot be guaranteed. Users must undertake the responsibility to critically assess and validate the AI-generated content for their intended use. Moreover, users are required to observe ethical standards and legal regulations concerning copyright and intellectual property rights. This entails avoiding the use of the Service for creating or distributing content that infringes upon copyright or proprietary rights of others. By utilizing the Service, users acknowledge these constraints and commit to using both the Service and the content it generates in a responsible, ethical, and legally compliant manner.
10. Service Fees
The Company reserves the right to modify, change, or update the pricing and usage limitations associated with our plans at any time without prior notice. This may include changes to subscription fees, per-use fees, and any usage limitations applied to different tiers or plans offered by the Service. Such changes will be effective immediately and may be reflected in your service plan upon renewal or at the time of purchase. By continuing to use the Service after such changes are implemented, you agree to be bound by the revised fees and limitations.
11. Refund Policy
a. Subscription Service Refund Policy
Scope: A 14-day money-back guarantee is offered for our subscription service. Eligible subscribers can request a full refund within the first 14 days of their subscription start date. This policy applies only to the first subscription period.
Eligibility: The refund request must be made within 14 days of the subscription start. The account must not have violated any service terms.
Procedure: To initiate a refund, email support@giz.ai with your account information and reason for the refund. Approved refunds will be processed to the original payment method within 10 business days.
Refund Calculation: If you cancel on the same day of signing up, you will receive a full refund. For cancellations within the 14-day period, a partial refund will be issued based on the days the service was used. The refund amount will be calculated by subtracting the value of the services used from the total amount paid.
Limitations:
– Refunds do not apply to: Additional charges beyond the subscription fee. Accounts terminated for terms of service violations.
– No refunds will be issued after the 14-day period has elapsed. All sales are final after this period.
b. EU Customer Refund Policy
Scope: For EU customers, in accordance with EU consumer protection laws, we offer a 14-day right of withdrawal period. This policy applies to our subscription service.
Eligibility: EU customers have the right to withdraw from the subscription without giving any reason within 14 days from the start of the subscription. The account must not have violated any service terms.
Procedure: To exercise your right of withdrawal, email support@giz.ai within the 14-day period. Include your account information and state your intention to withdraw from the subscription.
Refund Processing: Approved refunds will be processed to the original payment method within 10 business days.
Limitations: After the 14-day period, no refunds will be granted, and our standard refund policy applies.
12. Termination
The Company may terminate or suspend your access to the Service without notice if you breach these Terms. Upon termination, your right to use the Service will immediately cease.
13. Disclaimers
The Service is provided on an “as is” and “as available” basis. The Company expressly disclaims all warranties, express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
14. Limitation of Liability
The Company will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data arising from your use of the Service, even if the Company has been advised of the possibility of such damages.
15. Governing Law
These Terms shall be governed and construed in accordance with the laws of the jurisdiction in which the Company is registered, without regard to its conflict of law provisions.
16. Dispute Resolution
All disputes related to these Terms or the Service will be resolved by arbitration or in a small claims court, unless you opt-out in accordance with the arbitration agreement specified within these Terms.
17. General Provisions
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.
